The
Sheriff is the designated enforcement officer of the Supreme Court of
New York and shares concurrent jurisdiction for enforcement of lower
court mandates with the constables and marshals of those courts. In
addition, the Sheriff is required to accept and serve civil process.
Pursuant to the New York State Constitution and other laws, the Sheriff
maintains the Civil Division in order to discharge these required
duties. The Civil Division is responsible for receiving, docketing and
serving civil process of New York and out of state courts and returning
the appropriate proofs of service. The Civil Division is also
responsible for the execution of court orders and Mandates including
warrants of eviction, writs of assistance, civil arrest warrants, orders
of seizure, orders of attachment and orders directing the conveyance of
real property. The Civil Division enforces judgments through enforcement
of income and property executions directing the garnishment of wages,
the delivery of real property and the sale of real property at public
Sheriff's sales. The proceeds of these enforcement procedures are
collected and disbursed to the judgment creditors on a monthly basis.
Sheriff's fees received for the service and enforcement of civil process
and mandates are collected pursuant to law and remitted to the County
Treasurer. |
